This privacy policy .(referred to hereafter as the " Policy") explains how Jeeny collects, processes, and protects Your Personal Data when You use the Jeeny platform through Your mobile device hereinafter referred to as (the "Application” or “Platform”). Jeeny is a licensed ride-hailing platform operating under Electronic Speed Trading Company LLC. organized under the laws of the Kingdom of Saudi Arabia (hereinafter referred to as “KSA”), registered in the commercial register of Jeddah under registration number 4030249941 and unified number 7001776199, with its principal office located in Riyadh, Qurtubah District, Al-Thumama Street 13248, KSA. Our primary activities include providing safe, efficient, and reliable transportation services to passengers through a network of registered drivers using our Application (“Services”). We target individuals within KSA who seek convenient transportation services, and we ensure compliance with all applicable transport regulations and data protection laws. Our Services and Application are regulated and supervised by the Transport General Authority.


We are fully committed to providing the highest level of protection for Your Personal Data (referred to hereafter as "Personal Data" or “Data”) in accordance with the Personal Data Protection Law- the Saudi Cabinet Decision No. 1443/98 regarding the approval and adoption of personal Data protection, (hereinafter referred to as “PDPL”)  as Well as Royal Decree No. M 148 issued on 05/05/1444H and their associated executive regulations, as amended from time to time. (hereinafter collectively referred to as the “Law”)

 

As the Data Controller under the Law, Jeeny determines the purposes and means of processing Your Personal Data. This Privacy Policy outlines the specific categories of Personal Data We collect, the purposes for which We use it, and the safeguards We implement to protect it. We process Your Personal Data in line with the principles set out in this Policy read in light with the Law to ensure it is handled securely and lawfully when You use Our Services  provided through the Application 

 

This Privacy Policy applies to all users of the Application, including passengers, drivers, and business partners or anyone who interacts with Our Services through the Application (collectively referred to as "Users" and individually referred to as “ You” “Your” or “User”).

 

By Using the Application that provide Our Services, You agree to the terms of this Privacy Policy. If You do not accept these terms, We request that You discontinue Using the Application, as refusal to accept the Privacy Policy may limit Your ability to access the Services provided by Jeeny.

 

Please note that this Privacy Policy may be updated to reflect changes in Our practices or any amendments to the Law including the Personal Data Protection Law, Executive Regulations, or new requirements from SDAIA. We collect Personal Data from Users to provide, enhance, and improve Our Services. This Data is collected directly from You, through the Jeeny mobile application (the "Application"), or from third parties with Your consent. The Data We collect is essential for fulfilling Our legal obligations and ensuring the smooth operation of the Application. If You choose not to provide certain Personal Data or request its deletion, this may limit Our ability to provide You with certain Services.

 

It is Your responsibility to ensure that the Personal Data you provide to Jeeny is accurate, complete, up-to-date and not forged or fake. By providing your Data, you confirm that the information is correct and that You will promptly inform Jeeny of any changes or inaccuracies.

 

If inaccurate or outdated information is provided, this may impact our ability to offer Services effectively or comply with legal requirements. Jeeny cannot be held liable for any issues arising from inaccurate or incomplete Data provided by the User.

When We gather enough Personal Data from You to set up an account, We will create a unique account number known as Your “Jeeny Account ID.” This ID is exclusive to You and serves as a means for Us to identify You across Our different Services and locations

Jeeny is the Data Controller responsible for the collection and ultimately decides why and how the Personal Data is collected, processed and shared for Services on the Application and is responsible for ensuring that Your Personal Data is collected and processed securely in accordance with the Law and this Privacy Policy. Jeeny collects and processes Your Personal Data for specified, lawful purposes outlined in this Privacy Policy ensuring that Data is used only as necessary to operate Our Services and fulfill Our obligations.

 

Jeeny may engage third-party processors to perform certain Services on Our behalf. In these cases, We implement contractual safeguards requiring them to adhere to Our security standards and legal obligations under the Law.

Limitations of Liability

While We take reasonable steps to protect Your Personal Data, Jeeny cannot be held liable for any unauthorized access to Your account or Personal Data resulting from Your failure to maintain adequate security measures (e.g., sharing passwords or using weak credentials). A.  Sharing Your Personal Data with Third Parties and Cross Border Transfers

To operate the Jeeny Application and provide quality Services, We may share Your Personal Data with select Third parties under specific conditions, including those located outside KSA. These transfers are conducted in compliance with Law and are governed by agreements and safeguards to protect Your Data. Third Party Recipients of Personal Data. (“Third Parties”)

Companies working on behalf of Jeeny, to facilitate Services through the Application including, but not limited to, Data analytics, payment processing, marketing activities and communications (for more details please refer to the Marketing Section below), and personalization features. These entities act as Data Processors and handle Your Personal Data soley under Jeeny’s instructions and for Jeeny’s purposes. 

  1. Corporate Transactions:

In the event of a sale, merger, liquidation, receivership, or transfer of Jeeny’s assets or those of one of Our affiliates , Personal Data may be transferred to the prospective buyer and their professional advisers.

  1. Affiliates and Group Companies:

Companies within the same corporate group for purposes including aggregate Data analysis, User profile management, Service personalization and with Your consent,  targeted marketing communications. These affiliates uphold Data protection standards similar to Jeeny’s to ensure the confidentiality and lawful processing of Your Data.

Parties who are legally entitled to access Personal Data, including authorities requesting Data via the Law, court orders, or regulatory mandates. This also includes sharing information with other companies and organizations for fraud protection.

B.  Cross Border Data Transfers and Storage

The Personal Data may be disclosed, to the aforementioned categories of Third Parties who have their registered offices in the KSA or other jurisdictions as necessary for technical or operational reasons. They may act as Data processors on behalf of Jeeny or as separate Data controllers, providing You with the necessary information under their own responsibility. 

 

Any transfer of your Personal Data outside Saudi Arabia will occur only to countries that offer adequate levels of data protection comparable to those required by the Law. Jeeny ensures that the countries to which Data is transferred have in place data protection laws and standards aligned with Saudi Arabia's requirements, thereby ensuring the continued security and confidentiality of your Data. When Data is transferred outside Saudi Arabia,  and even if the country receiving the Data does not have stringent data protection standards, We ensure that appropriate safeguards are in place, including:

  • Standard Contractual Clauses: Agreements with third parties stipulating that they will protect Personal Data to the standards required under the PDPL.
  • Data Processing Agreements: Contracts that clearly define the roles and responsibilities of Third parties as Data processors or independent Data controllers, with stringent Data protection obligations.

Your Personal Data is primarily stored on servers located in the KSA. If it becomes necessary to use cloud-based systems or Services based outside Saudi Arabia, Jeeny ensures that appropriate safeguards, such as standard contractual clauses and valid contracts with processors, are in place to protect Your Data.

C.  Third Party Applications and Websites

 

This Privacy Policy applies only to Personal Data collected on Jeeny ‘s Application. We are not responsible for the content or privacy practices of Third-party applications and Websites operated linked to or from the Jeeny Application. We encourage You to review the privacy policies of any Third Party applications or websites before providing them with Your Personal Data.

Your Personal Data will be retained only to the extent necessary to fulfill the purposes for which it was collected, or as otherwise required by the applicable legal and regulatory obligations under the Law unless there is a legal basis for retaining the Data beyond the purpose of collection but shall be destroyed upon the lapse of that period. We retain Data based on the following considerations:

  1. Transaction Data: Transaction Data will be retained for the duration required by applicable financial and legal regulations read in light with the Law and based on specific regulatory mandates.

Jeeny  is committed to protecting the privacy of children and does not knowingly collect, retain or process Personal Data of individuals under the age of 18 (“Children” or “Child”). The Jeeny Application may only be used by individuals who are 18 years of age or older and who can form legally binding contracts under Law.

 

If You book or Use Our Services on behalf of a Child (e.g through a parent or guardian’s account), We may by necessity, collect limited Data indirectly related to the Child. By Using Our Services on behalf of a Child You represent and warrant that:
